The New York State Legislature is the legislative branch of New York State and consists of the Senate and the Assembly. The Senate has 63 members, each serving a two - year term, while the Assembly has 150 members, also serving two - year terms. Currently, the Senate is controlled by the Republican Conference (comprising 29 Republicans and 5 Independent Democrats who caucus with the Republicans), and the Assembly is controlled by the Democrats, who hold 105 seats compared to the Republicans' 43 seats. The primary functions of the New York State Legislature include drafting bills, enacting laws, approving the state budget, and overseeing the operations of the state government. The Legislature holds its legislative sessions annually in the New York State Capitol in Albany, the state capital. These sessions typically begin in January and continue through June.
