On April 8, 2026, Peru's Ministry of Environment (MINAM) published Supreme Decree No. 005-2026-MINAM in the Official Gazette of Peru, approving the implementing regulations for Legislative Decree No. 1570 (the Comprehensive Chemicals Management Law). The regulations will enter into force six months after publication (i.e., October 2026).
Main Contents of the Regulations
I. Scope of Application
The regulations apply to all natural and legal persons (whether public or private) involved in comprehensive chemicals management or acting as chemical users within the territory of Peru.
II. Core Definitions and Concepts
The regulations establish a complete terminology system for chemicals management, including:
- Chemicals: Covering substances (single-component, multi-component, UVCB substances) and mixtures
- Hazardous chemicals: Substances or mixtures classified as physical hazards, health hazards, or environmental hazards under the Globally Harmonized System of Classification and Labelling of Chemicals (GHS)
- Life cycle: Including raw material acquisition, manufacturing, distribution, use, recycling, and final disposal
- Risk approach: A systematic comprehensive management framework based on registration/inventory, prioritization, risk assessment, and risk management measures
III. Key Management Systems
1. National Chemicals Registry (RENASQ) A national chemicals register is established, requiring manufacturers and importers to report the quantities of hazardous chemicals manufactured and/or imported in the previous year.
2. Chemicals Classification
- Adopts the Globally Harmonized System of Classification and Labelling of Chemicals (GHS)
- Distinguishes between:
- Existing chemicals: Chemicals already registered before the end of the adaptation period on September 30, 2031
- New chemicals: Chemicals not registered within the aforementioned adaptation period
3. Exclusions The regulations explicitly exclude the following substances:
- Natural and artificial radioactive substances (governed by Law No. 28028)
- Specific products governed by special regulations, including pharmaceuticals, foodstuffs, cosmetics, pesticides, etc.
