Canada Officially Lists Two Toxic Substances under Environmental Protection Act

On February 14, 2025, Pursuant to Section 90(1) of the Canadian Environmental Protection Act, 1999 (CEPA), the Government of Canada has formally added two high-concern chemical substances to Part 1, Schedule 1 of the Act (List of Toxic Substances). This regulatory action aims to restrict their production, use, and import to mitigate ecological and public health risks.

Scientific Basis

Joint assessments by Environment and Climate Change Canada (ECCC) and Health Canada confirm that both substances exhibit persistence, bioaccumulation potential, and toxicity (PBT properties). These chemicals may accumulate through food chains, posing threats to wildlife and human populations.

Compliance Requirements

Effective immediately upon registration (February 14, 2025):

1. All commercial production, import, or use of these substances must comply with CEPA Sections 64 to 99, including:

  • Mandatory risk assessments
  • Substitution plan submissions
  • Emission control protocols

2. Entities holding existing inventories must submit a special application to ECCC for disposal or limited exemptions.
