The priority management chemicals in Taiwan,China are regulated by the Regulations for Governing Designating and Handling of Priority Management Chemicals (hereinafter referred to as the Priority Management Regulations) under the Occupational Safety and Health Act, which came into effect on January 1, 2015. Chemicals included in the list of priority management chemicals are in Provision 2 of Article 2 of the Priority Management Regulations, which include a total of 889 chemicals prescribed in Appendix 2 of the Priority Management Regulations.

In accordance with the Priority Management Regulations, operators (manufacturers, importers, suppliers or employers) involving the priority management chemicals (including mixtures containing more than 1% by weight of the listed substances) in the List shall report relevant information to the competent authority for records. If the number of workers is 100 or more, the operator shall file the report within 6 months from the date of announcement by the competent authority. If the number of workers is less than 100, the report for record shall be submitted within 18 months from the date of announcement by the competent authority. Starting from the year following the record submission, regular updates of operational data shall be carried out between April and September annually to ensure the accuracy and effectiveness of the data.

However, operators shall submit the report in the following circumstances: (1) Operating two or more priority management chemicals prescribed in the list, where the maximum aggregate operating quantity of the individual chemical does not reach the threshold, but the sum derived is greater than or equal to 1; (2) substances classified as category 1of carcinogen, mutagen or reproductive toxicants or mixtures containing more than 1% by weight of these substances, regardless of the total annual operating quantity.

Chemical substances that are not included in the List of Priority Management Chemicals (version 2.2) are not subject to corresponding obligations.

Exemptions

  1. Hazardous industrial waste;
  2. Tobacco or tobacco products;
  3. Food, beverages, medications, and cosmetics;
  4. Finished goods;
  5. General consumer goods for non-industrial purposes in daily life;
  6. Fire extinguisher;
  7. The intermediate product of a chemical reaction that is currently taking place in a reactor or process;
  8. Other items designated by the central competent authority.
