China Unveils List of Dual-Use Items Subject to Export Control

On November 15, 2024, the Ministry of Commerce, the Ministry of Industry and Information Technology, the General Administration of Customs, and the State Cryptography Administration of the People's Republic of China jointly issued the "List of Dual-Use Items Subject to Export Control of the People's Republic of China" (Ministry of Commerce Announcement No. 51 of 2024) (hereinafter referred to as the "Control List"), which will be implemented starting from December 1, 2024.

The "Control List" specifies the structure and coding rules of the list, normative explanations of the list, definitions of related terms, and the specific catalog of items. It is applicable to the export control activities of dual-use items in China.

Concurrent with the implementation of the "Control List," 11 announcements, including Announcement No. 5 of 2003 by the Ministry of Commerce and the General Administration of Customs ("Announcement on the Temporary Export Control of Tributyl Phosphate") are repealed (see attachment); the contents related to the "Commercial Cryptography Export Control List" and the export licensing procedures attached to Announcement No. 63 of 2020 by the Ministry of Commerce, the State Cryptography Administration, and the General Administration of Customs ("Announcement on the Issuance of Commercial Cryptography Import Licensing List, Export Control List, and Related Management Measures") will no longer be applicable.

According to a spokesperson from the Ministry of Commerce, the establishment of the "Control List" is a systematic integration of all currently controlled dual-use items to establish a complete list system and regime, and it does not involve adjustments to the specific scope of control. China has always adhered to the principles of rationality, prudence, and moderation in the control of dual-use items. Currently, the number of controlled dual-use items is only about 700, which is significantly fewer than in major countries and regions.
