China-Regarding the regulation of lithium battery exports after August 1, 2024.

Specific Q: The Announcement No. 10 of 2023 by the State Administration for Market Regulation stipulates that, starting from August 1, 2024, lithium batteries that have not obtained the CCC certification certificate and marked with the certification mark shall not be manufactured, sold, imported, or used in other business activities. I would like to ask, starting from August 1, 2024, will the customs add new regulatory conditions for the export of lithium batteries or verify relevant certificates (HS code 8507600090)? What should our company pay attention to when we purchase batteries from domestic battery manufacturers and export them abroad in our company's name? What should be noted when lithium batteries are exported abroad directly in the name of domestic battery manufacturers? Thank you! Note: The lithium batteries mentioned above are lithium-ion batteries and battery packs (0915) listed in the Annex "Scope Definition of New Products Included in CCC Certification" of the Announcement No. 10 of 2023 by the State Administration for Market Regulation.

A: 1. According to the "Law of the People's Republic of China on Import and Export Commodity Inspection" and its implementing regulations, customs authorities implement verification management for import and export commodities that are required to be certified by the state. The Announcement No. 10 of 2023 by the State Administration for Market Regulation stipulates that, starting from August 1, 2024, China will implement mandatory CCC certification management for lithium-ion batteries/cells and portable power sources. Those without CCC certification and certification marks are not allowed to be manufactured, sold, imported, or used in other business activities. Customs authorities, in accordance with relevant laws and regulations, implement verification management and statutory commodity inspection for imported lithium-ion batteries/cells, verifying the CCC certification certificate, certification mark, and conducting commodity inspection, etc. At present, there are no requirements for verification management and commodity inspection for exported lithium-ion batteries/cells. At the same time, export enterprises purchasing lithium batteries produced and sold domestically should also comply with China's mandatory CCC certification management requirements for lithium-ion batteries/cells. 2. For lithium battery products transported as dangerous goods, according to Article 29 of the Regulation on the implementation of the Law of the People's Republic of China on Import and Export Commodity Inspection, the battery manufacturing enterprises should apply to the competent customs authorities at their location for the use appraisal of dangerous goods packaging containers. Only after the customs authorities have qualified the appraisal of dangerous goods packaging can the products be exported.
