商务部解答《关于加强相关两用物项对美国出口管制的公告》 | regulatory trends

2024年12月3日，商务部发布《关于加强相关两用物项对美国出口管制的公告》（商务部公告2024年第46号）（以下简称《公告》），决定加强相关两用物项对美国出口管制。《公告》自公布之日起正式实施。商务部新闻发言人就加强相关两用物项对美出口管制的问题回答了记者的提问，具体内容如下：

问：我们注意到商务部发布公告，针对美国加强两用物项出口管制，请问是出于什么考虑？

答：近年来，美方泛化国家安全概念，将经贸科技问题政治化、武器化，滥用出口管制措施，无端限制有关产品对华出口，并将多家中国企业列入制裁清单进行打压遏制，严重破坏国际贸易规则，严重损害企业正当合法权益，严重破坏全球产业链供应链稳定。

为维护国家安全和利益、履行防扩散等国际义务，根据《中华人民共和国出口管制法》等法律规定，中方决定加强有关两用物项对美国出口管制，包括禁止两用物项对美国军事用户或军事用途出口，严控镓、锗、锑、超硬材料、石墨相关两用物项对美国出口等。任何国家和地区的组织和个人违反相关规定，将依法追究责任。

中国政府坚定不移推进高水平对外开放，坚决反对任何泛化国家安全概念的错误做法。中方愿与有关国家和地区加强出口管制领域对话，共同促进全球产业链供应链的安全与稳定。
