Ukraine to Implement CLP Regulations

In March 2024, Ukraine submitted a draft regulation to the World Trade Organization (WTO) on the Classification, Labeling, and Packaging (CLP) of chemicals, announcing that the draft will officially come into effect on June 29, 2024. The Ukrainian CLP regulation draft is based on the European Union CLP standards.

Scope of Application

This draft regulation applies to chemical products that are either marketed or produced within Ukraine but not yet placed on the market. Chemical products or mixed substances that do not comply with the requirements of the Ukrainian CLP regulations are not permitted for circulation on the Ukrainian market.

The draft do not apply to the following situations:

  • Radioactive substances;
  • Chemical products under customs supervision, as well as those temporarily stored in free trade zones or warehouses for re-export or transit without processing or treatment;
  • Non-insulated intermediate chemical substances;
  • Chemical products used exclusively for scientific (technological) research, which are not sold on the Ukrainian market;
  • Waste.

 

Labeling Requirements

According to the draft, all chemical products must be accompanied by clear and easily understandable labels on their packaging. These labels should be classified according to sections B to D of Annex I of the draft, clearly indicating the relevant hazard information, safety usage guidelines, and emergency contact details for the chemical products.

 

Items Subject to Phased Implementation

The draft specifies that Section 3, along with paragraphs 135 to 138, will come into effect on January 1, 2025.

Section 3 mandates that all packaging of chemicals identified as hazardous must bear hazard information. This includes a hazard identification code, hazard symbols, precautionary statements, and alternative names for the chemical substances.

Paragraph 135 to 138 of Section 6 require that, to ensure timely medical aid and information in emergency situations, the Ukrainian Ministry of Health will develop preventive and treatment measures with a special focus on injuries caused by chemical products. Companies must provide detailed information about their chemical products, including chemical composition and potential hazards, to the central authority responsible for health policy.

The implementation of the Ukrainian CLP Regulations is a significant step for Ukraine towards aligning with international standards in chemical safety and management. Relevant companies need to prepare in advance and adjust their production and management strategies in a timely manner to avoid compliance risks.
