Vietnam's Three Supporting Regulations for the Law on Chemicals Take Effect! Covering New Regulations on Hazardous Chemicals

On January 17, 2026, the Ministry of Industry and Trade of Vietnam announced that the Law on Chemicals (No. 69/2025/QH15) officially took effect on January 1, 2026. To support the implementation of the Law on Chemicals, three government decrees have been formally promulgated, all of which took effect on January 17, 2026.

Government Decree No. 24/2026/NĐ-CP: Specifies the lists of chemicals under the purview of the Law on Chemicals.

The specific lists are published in the form of appendices, including:

  • List of Basic Chemicals in Key Chemical Industries (Appendix I): Includes 39 substances.
  • List of Chemicals Subject to Conditional Production and Trading (Appendix II): Includes 786 substances and mixtures subject to conditional production and trading. It clarifies that mixtures subject to conditional production and trading refer to mixtures containing at least one component from this list with a mass fraction greater than 5%.
  • List of Chemicals Subject to Special Control in Production and Trading (Appendix III): Includes two groups totaling 241 precursors and mixtures subject to special control.
  • List of Chemicals Requiring Accident Prevention and Response Plans (Appendix IV): Covers 271 chemicals and 21 chemical groups.

Government Decree No. 25/2026/NĐ-CP: Provides detailed regulations and measures to organize and guide the implementation of certain provisions of the Law on Chemicals regarding chemical industry development and chemical safety and security.

This decree consists of 8 chapters and 41 articles, covering state management responsibilities, the formulation, evaluation, approval, and implementation of chemical industry development strategies, technical requirements for chemical projects, safety measures for chemical activities, specialized safety training, and chemical accident prevention.

Government Decree No. 26/2026/NĐ-CP: Provides detailed regulations and guidance for implementing certain provisions of the Law on Chemicals regarding the management of chemicals in products and goods, as well as hazardous chemical activities.

This decree consists of 5 chapters and 31 articles, with the main contents including:

  • Chemical Import Declaration

Importers of chemicals under Chapters 28 and 29 of the Vietnam List of Import and Export Goods must declare them on the National Single Window system before customs clearance.

Exemptions from declaration include:

a) Import of chemicals subject to special control;

b) Import of prohibited chemicals;

c) Import of new chemicals for testing or evaluating chemical and physical properties, with a single invoice import quantity of less than 10 kg;

d) Chemical components in mixtures with a content below 0.1%;

e) Hazardous chemicals published in accordance with this decree.

  • Hazardous Chemicals

Competent industry management agencies shall publish lists of products and product categories containing hazardous chemicals requiring public disclosure, in accordance with Article 31, Clause 2 of the Law on Chemicals.

Control procedures for hazardous chemicals in the production process must ensure the following objectives:

a) Monitoring the composition and content of hazardous chemicals in raw materials;

b) Monitoring the composition and content of hazardous chemicals emitted during production;

c) Monitoring the composition and content of hazardous chemicals in final products;

d) Preventing the loss of hazardous chemicals.

  • Disclosure of Hazardous Chemical Content Information

Organizations and individuals producing or importing products and goods containing hazardous chemicals must declare the following information in the specialized chemical database:

a) Name of the product or goods containing hazardous chemicals;

b) Name of the hazardous chemical;

c) Hazard characteristics of the chemical;

d) Content;

e) Field of use of the product.

Additionally, information on the composition and content of hazardous chemicals must be disclosed on labels or electronic information pages, along with recommendations for usage restrictions.

These supporting regulations collectively facilitate the effective implementation of the Law on Chemicals, marking a new phase of systematic chemical management in Vietnam.
