The Deadline for UK REACH Registration Extended by Three Years

On June 28, 2023, UK published the REACH (Amendment) Regulations 2023 (No.722) which extends the time required to submit information by a further 3 years. The REACH (Amendment) Regulations shall enter into force on July 19, 2023. From July 19, 2023, dossier submission deadlines of substances in different tonnage shall be extended to 27 October 2026, 27 October 2028, and 27 October 2030 respectively (new transitional period).

Of UK REACH

The UK REACH (Registration, Evaluation, Authorisation and Restriction of Chemicals) Regulation is one of the main legislation for chemical management in Great Britain, which regulates substance uses in Great Britain, while EU REACH continues to apply in Northern Ireland. UK REACH requires substances that are manufactured in, or imported into Great Britain to be registered with the Agency for UK REACH - the Health and Safety Executive (HSE). Registrations shall be made when they involve hazards, uses, and exposure. Registration information is used by the HSE for regulatory purposes and by the registrants to identify appropriate risk management measures for themselves and other downstream users.

The UK REACH Regulation contains transitional provisions to reduce the disruption to the industry as they moved to the new regime from EU REACH. These provisions allow companies to submit initial “notification” data to continue trading and then provide full registration data. When the REACH (Amendment) Regulations 2023 enters into force on July 19, 2023, the submission deadlines shall be:

  • October 2026: for substances included on the EU REACH candidate list before UK REACH came into effect on 31 December 2020; substances that are carcinogenic, mutagenic or toxic for reproduction and manufactured or imported in quantities of 1 tonne a year or more; substances that are very toxic to aquatic life and manufactured or imported in quantities of 100 tonnes or more a year; and all substances manufactured or imported in quantities of 1,000 tonnes or more a year.
  • October 2028: for substances added to the UK REACH candidate list before the above submission deadline; and all substances manufactured or imported in quantities of 100 tonnes or more a year.
  • October 2030: for all substances manufactured or imported in quantities of 1 tonne or more a year.

Introduction of REACH (Amendment) Regulations 2023 (No.722)

  • Purpose of the instrument

    1.1 The purpose of this instrument is to extend the current legislative deadlines for registrants to submit information to the Health and Safety Executive (“HSE”) under UK REACH. Extending these deadlines will provide sufficient time for the government to develop and introduce a new transitional registration model.

    1.2 The dates by which the HSE are required to carry out their compliance checks are amended.

  • Amended context

3.1 It amends the definition of “relevant post-IP completion period” in Article 127P(4B) by extending the time required to submit information by a further 3 years, from 27 October 2023, 27 October 2025 and 27 October 2027 to 27 October 2026, 27 October 2028, and 27 October 2030 respectively.

3.2 Compliance checks by HSE are extended; HSE must carry out 20% of compliance checks to 27 October 2027, 27 October 2030 and 27 October 2035.
