Recently, in the exercise of the powers conferred by section 76(1) of the Environmental Protection and Management Act 1999, the Minister for Sustainability and the Environment has officially promulgated the Environmental Protection and Management Act 1999 (Amendment of Second Schedule) (No. 3) Order (S183/2025).
Main Revisions
This Order updates the scope of control for the following chemical substances in the Second Schedule of the Environmental Protection and Management Act:
1. Dechlorane plus
- Exclusions:Adhesives;Fillers;Medical devices;Plastics;Substances, preparations or products used in the aerospace sector;Substances, preparations or products used in the defence sector;Substances, preparations or products used in the space sector;Replacement parts for, or the repair of, any of the following articles that were originally manufactured using Dechlorane plus:(a)articles used in the aerospace sector;(b)articles used in the defence sector;(c)articles used in the space sector;(d)equipment used in the marine industry;(e)equipment used for gardening or forestry;(f)instruments for analysis, measurements, control, monitoring, testing, production or inspection;(g)medical devices;(h)motor vehicles;(i)outdoor power equipment;(j)stationary industrial machines used for agriculture, forestry or construction.
2. UV-328
- Exclusions:.Adhesives;Fillers;Heavy-duty coatings for large steel structures;Industrial coatings for motor vehicles, engineering machines or rail transport vehicles;Mechanical separators in blood collection tubes;Medical devices;Parts of motor vehicles;Photographic paper;Plastics;Triacetyl cellulose (TAC) film in polarisers;Replacement parts for any of the following articles that were originally manufactured using UV-328:(a)liquid crystal displays in instruments for analysis, measurements, control, monitoring, testing, production or inspection;(b)medical devices;(c)motor vehicles;(d)stationary industrial machines used for agriculture, forestry or construction.
