On April 13, 2026, the Innovation, Green Transformation and Industrial Promotion Agency under the Ministry of Industry and Trade of Vietnam issued Official Dispatch No. 2542/BCT-ĐCK, promulgating a draft list of medium-risk and high-risk products and goods, and opening it for public comments.
This Official Dispatch aims to implement the Ministry's plan to issue a notification on the list of medium-risk and high-risk products and goods within its state management responsibilities. The draft has been researched and prepared in accordance with the Law on Promulgation of Normative Legal Documents, the amended Law on Product and Goods Quality, the amended Law on Standards and Technical Regulations, and their detailed implementation guidelines.
Background and Purpose
Many industrial product groups pose potential safety risks during use due to their technical, chemical, or mechanical characteristics. Therefore, these products and goods need to be strictly managed under the Law on Product and Goods Quality through the application of national technical regulations, conformity assessment, quality inspections during production, import, and market circulation.
Establishing a list of products and goods with varying risk levels and applying appropriate management measures aims to ensure that products and goods meet safety and quality requirements before being placed on the market. This helps prevent and limit potential accidents, protect people's health and lives, and maintain order and safety in production and business activities.
Core Content
This Notification promulgates the list of medium-risk and high-risk products and goods under the state management responsibilities of the Ministry of Industry and Trade.
- Appendix I (List of Medium-Risk Products and Goods): Includes certain industrial explosives, industrial detonators, etc.
- Appendix II (List of High-Risk Products and Goods): Includes certain explosive precursor substances, etc.
Appendices I and II provide detailed information such as product/good names, HS codes, applicable technical regulations, etc.
Quality management for products and goods specified in Appendices I and II shall be carried out in accordance with the relevant MOIT notifications (stipulating quality management of products and goods under the Ministry's state management) and corresponding national technical regulations.
For products and goods not included in the medium-risk and high-risk lists in the appendices of this Notification, quality management shall be implemented in accordance with the legal provisions on product and goods quality and other relevant legal documents.
Call for Comments
Relevant agencies and organizations are requested to study the above draft and provide comments so that the Ministry of Industry and Trade can finalize it before official promulgation. Feedback should be submitted to the Innovation, Green Transformation and Industrial Promotion Agency no later than April 25, 2026.
Effective Date
This Notification takes effect from July 1, 2026.
Notification No. 41/2023/TT-BCT issued by the Ministry of Industry and Trade on December 28, 2023 (promulgating the list of products and goods that may cause unsafety under the Ministry's management responsibilities) will be annulled from the effective date of this Notification.
Management Measures Recommendations
- Mandatory compliance with health safety and environmental regulations for medium-risk and high-risk products and goods during use, production, circulation, and consumption.
- Regularly review warning information from competent authorities to ensure timely response and proactive response to new threats.
- For medium-risk products and goods, strengthen conformity certification controls and strictly monitor indicators such as chemical safety and fire/explosion prevention.
- For high-risk products and goods, in addition to traceability as required, carry out pre-market inspections while enhancing strict control and supervision.
The Ministry of Industry and Trade must continuously review the lists, removing products and goods whose quality has stabilized from the medium-risk and high-risk lists, and adding new products and goods that require management, to ensure alignment with international integration requirements and Vietnam's actual situation.
